Course Description:

You are an agent and someone approaches you to list their deceased parent’s property – can they sign a Listing Agreement? Your clients are divorced and have a house to sell, what if one spouse won’t sign the contract – what do you do? An investor has a contract to buy a property & wants to sell or assign the contract – can you list the property yet? When working with an LLC, how do you know that the person with whom you are dealing may engage the company in business? What contract forms may I use before a person has signing authority & how do they sign after they have signing authority? What do I have to disclose in a real estate Brokerage Agreement or Purchase & Sale Agreement? This course introduces Real Estate Agents to the contractual and legal issues of these scenarios with respect to the listing and sale of real property in Georgia.

Course Objectives:

Upon completion of this course, students will understand:

How to assist the Buying & Selling public with their real estate needs when they are involved with an estate, divorce, an investor or dealing with a business entity;

How to guide clients & customers with respect to these issues without practicing law;

What documentation is necessary for a person to sign a real estate contract;

When is it required to take an estate through probate;

How to differentiate a person on title vs. responsible for a mortgage;

How to research GSCCCA & Georgia Secretary of State for title information;

What is necessary for an enforceable contract for real property in Georgia;

The differences between a voidable and invalid and unenforceable contract for real property in Georgia.
